Terms of Service

1. Acceptance of terms
Election Edge is provided by Election Edge(“Election Edge”, “we”, “us”). By using any Election Edge service, you agree to these terms. If you do not agree, do not use the platform. We may update these terms; continued use after changes constitutes acceptance.
2. The service
Election Edge provides parallel vote count tooling, agent management, polling-station evidence capture, and related election-integrity services. The platform launches with the Kenya 2027 General Election and will extend to additional jurisdictions over time.
3. User accounts
- You must be at least 18 years old to create an account
- You are responsible for maintaining the security of your account
- One person, one account - no impersonation or fake accounts
- Campaign accounts require identity verification
- Multi-factor authentication is required for privileged roles
4. Acceptable use
You agree not to:
- Submit false election data or fabricated evidence
- Attempt to manipulate the parallel tally or result projections
- Scrape, crawl, or bulk-access the platform without authorization
- Interfere with the platform's security or availability
- Use the platform for voter intimidation or electoral fraud
- Impersonate another user, election official, or representative of any election body
5. Election data integrity
Submissions to Election Edge are treated as election records. Knowingly submitting false data is a violation of these terms and may be reported to the relevant election body, law enforcement, or judicial authority.
Evidence submissions are immutable - once submitted, they cannot be modified or deleted. This is by design for legal integrity.
6. Intellectual property
The platform's code, design, and branding are owned by Election Edge. Data submitted by a campaign or organization remains theirs; it is isolated per campaign and is not made public or shared with other customers by Election Edge.
7. Privacy
Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data consistent with applicable data protection laws (including the EU/UK GDPR, the California Consumer Privacy Act, and the Kenya Data Protection Act 2019 where relevant).
8. Service availability
We aim for high availability, especially during election periods, but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability.
9. Limitation of liability
Election Edge provides tools for operational transparency and an independent parallel tally. We are not responsible for political, electoral, or legal outcomes influenced by use of the platform. Tally figures and projections are based on the data submitted by users and obtained from public sources, and may differ from official results until they are verified.
To the maximum extent permitted by applicable law, Election Edge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the platform.
10. Governing law and dispute resolution
These terms are governed by the laws of Kenya, without regard to its conflict-of-laws principles. Any dispute arising from these terms or your use of the platform shall first be addressed through good-faith negotiation, then mediation. Unresolved disputes shall be brought exclusively in the courts of Kenya, and the parties consent to the jurisdiction of those courts.
Nothing in this section limits any non-waivable consumer rights you may have under the mandatory law of your country or state of residence.
